§ 1 Scope, seller

(1) These terms and conditions apply to all orders placed through the online shop eigenjewels.com. The seller and your contractual partner is:

(2) The offer is directed at consumers and businesses based or habitually resident in Germany or another member state of the European Union. We deliver only to delivery addresses in Germany and the other member states of the European Union.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).

§ 2 Conclusion of the contract

(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.

(2) You can add products to the cart. After accepting these terms in the cart, you make a binding offer to buy the goods in the cart by clicking the “Place order” button and then completing payment on the payment page of our payment provider Stripe.

(3) We accept your offer at the moment payment is successfully completed; the contract is concluded at that moment. The confirmation page shown afterwards confirms your order. If payment is not completed, no contract comes about.

(4) Until payment is completed you can review and correct your entries at any time: in the cart by changing quantities or removing items, and on the Stripe payment page by correcting your details or returning to the cart.

§ 3 Contract language, storage of the contract text

(1) The contract language is German. An English translation of these terms is provided for information only.

(2) We do not store the contract text in a way that you can access it. You receive the order data by email (Stripe receipt). You can view, print or save these terms on this page at any time.

§ 4 Prices and shipping costs

(1) All prices are final prices. No VAT is charged under § 19 UStG.

(2) Shipping costs apply per order: €0.00 for delivery within Germany and €0.00 for delivery to other EU member states. Details are on the Shipping & payment page.

§ 5 Payment

(1) Payment is processed by the payment provider Stripe. The following payment methods are available: .

(2) The purchase price is due when the order is placed and is paid when payment is completed on the Stripe payment page.

§ 6 Delivery

(1) Our jewellery is made to order in small batches. Delivery takes after receipt of payment.

(2) Goods are delivered to the delivery address given with the order.

§ 7 Retention of title

The goods remain our property until paid in full.

§ 8 Liability for defects

The statutory provisions on liability for defects apply.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy.

§ 10 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health and for damage caused by intent or gross negligence.

(2) Otherwise we are liable only for breach of an essential contractual obligation, i.e. one whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case liability is limited to the damage that is typical for the contract and foreseeable.

(3) Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 11 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 12 Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence.
